§ 99-1. Title. back to top
The Village of Ellenville is hereby adopting the following provisions hereby designated as the "Fair Housing Code and Policy."
§ 99-2. Policy established; Commission created. back to top
It is hereby ordained and directed that the Village of Ellenville by this chapter adopts and establishes a Fair Housing Commission and establishes a fair housing policy. The Ellenville Human Rights Commission shall assume the additional duties related to fair housing and shall serve as the Fair Housing Commission. The purpose, policy, duties and procedures to be followed by the Commission under this chapter are set forth below.
§ 99-3. Relation to federal and state law. back to top
A. In accordance with Title VIII of the United States Code and the Human Rights Law of the State of New York, Editor's Note: See Executive Law § 290 et seq. it is the policy of the Village of Ellenville to provide fair housing.
B. The purposes of this chapter are those in accord with Title VIII of the United States Code as such section applies to fair housing.
§ 99-4. Definitions. back to top
All such definitions of the Human Rights Law of the State of New York as pertaining to fair housing are hereby restated by the village as a provision of this chapter.
§ 99-5. Unlawful discriminatory practices. back to top
All such unlawful discriminatory practices contained in the Human Rights Law of the State of New York Editor's Note: See Executive Law § 296 and 296-a. as pertaining to fair housing are hereby restated by the Village of Ellenville as a provision of this chapter.
§ 99-6. Fair Housing Office. back to top
There is hereby established a Fair Housing Office which is designated to administer this chapter. The head of such office shall be the Director of the Community Development Office, whose further title hereunder shall be the Fair Housing Officer of the Village of Ellenville.
§ 99-7. Powers and duties of Commission. back to top
The Fair Housing Commission, by and through the Fair Housing Officer, shall have the following functions, powers and duties:
A. To establish and maintain a principal office within the village as may be necessary.
B. Upon request, to obtain and utilize the services of all governmental departments and agencies.
C. To formulate policies to effectuate the purpose of this chapter.
D. To receive and investigate complaints alleging violations of this chapter.
E. To develop human rights, plans and policies for the village and to assist in their execution; to make investigations and studies appropriate to effectuate this chapter; to inform persons of the rights assured and remedies provided under this chapter; to provide good will; and to minimize or eliminate discrimination.
F. To render each year to the Mayor and to the Village Board a written report of all of its activities and of its recommendations.
G. To furnish any person with such technical assistance that the Commission deems appropriate to further compliance with the purposes or provisions of this chapter.
H. Such other powers and duties described hereinafter and as may be designated by the Mayor or otherwise authorized by the Village Board.
§ 99-8. Grievance procedure. back to top
A. Any person claiming to be aggrieved by an unlawful discriminatory practice may, by himself or by his attorney, make, sign and file with the Commission a verified complaint which shall state the name and address of the person or persons alleged to have committed the unlawful discriminatory practice complained of and which shall set forth the particulars thereof and contain such other information as may be requested by the Commission.
B. After the filing of the complaint, the Commission shall make a prompt investigation in connection therewith.
C. If, in the judgment of the Commission, the circumstances so warrant, it may, at any time after the filing of the complaint, endeavor to eliminate such discriminatory practice by conference, conciliation and persuasion.
§ 99-9. Effect on other governmental units and laws. back to top
A. Nothing contained in this chapter shall be construed so as to limit or prohibit any other governmental unit of competent jurisdiction, nor shall anything contained herein limit any aggrieved party, from pursuing any such situation. The Commission is hereby empowered to place any and all of its material obtained through the investigation at the disposal of such other governmental unit.
B. This chapter shall supersede all laws inconsistent with it to the extent of such inconsistency, but in all other respects shall be deemed supplemental to such laws.
